The certificate of inheritance

A certificate of inheritance is a notarial deed. It is not a letter from the family and not an extract that someone types themselves. In the file it belongs as a document, with the civil-law notary, the date and the estate it belongs to. As long as the deed is missing, the file does not state that it exists. An appointment with a civil-law notary is an appointment. The deed is the deed only when the document lies in the file.

Banks usually ask for it before they release a balance. That fact belongs with the bank account, not as a general story in a note. With the account it states whether the balance has been requested, whether the bank asks for the certificate, whether the certificate has already been issued and whether the bank has released the balance. The amounts come from the statement. The file invents no balance. A price for the deed is not recorded. There is no fee in the software.

The deed states who the heirs are insofar as the civil-law notary records that in that deed, and often who has authority to act. The file does not copy those names more broadly than the deed. An executor who is not in the deed does not receive that role because it is convenient for the bank. An heir whom the deed does not name does not receive a fraction out of habit. The certificate is a source beside the will and beside the statute. It is not the statute itself.

Release of a balance is an act of the bank. Ervazo does not release the balance and does not draw up the deed. On the timeline the question to the bank and the bank's answer stand as correspondence. An account that is still blocked remains visible in the estate inventory with the last known balance and the source of that balance. It is not set to zero because the certificate is still on its way. Nor is it booked as money received before the bank shows that.

The program keeps the deed and the bank's position. It makes no payment, files no tax return and does not execute a deed. It does not calculate by way of advice. A blocked account remains an entry with a source. The civil-law notary, the court or the Dutch Tax Administration (Belastingdienst) decides the specific case. Until the bank releases the balance, a release remains a question to the bank and not a fact in the estate inventory.
