Recording a dispute without deciding it

In a winding-up a difference of opinion almost arises of itself, about the home, about a piece of jewellery or about a gift. The executor does not resolve that by putting a tick next to a party in the software. You record the dispute as a note: who said what, on which date, and which document belongs with it. Besides that you make a task with the open question and the person who takes the next step, often the notary. The note is a report, not a judgment, and it does not say who is right. Software does not decide the dispute.

Write what you hear in neutral words. Not that someone is lying, but that one heir names a gift and the other says they have not seen it. Add which evidence has been named, such as a letter or a photo, without at once calling witnesses if that puts things on edge. Keep the email in which the position stands. You summarise a telephone conversation briefly and you can send it to the speaker for confirmation. Without that confirmation it remains an internal summary, not an acknowledged fact.

A status such as open or in consultation only says something about the administration. Do not set a field to paid out or allocated for as long as the parties do not agree or the notary has given no direction. A provisional division in a spreadsheet quickly becomes a promise in the family. Keep provisional figures apart from the account and justification, or label them clearly as a working version. Share a working version only if you write with it that it is not a decision. Otherwise someone reads a draft as a determination and you no longer keep it out of the conversation later.

Some quarrels do not belong with the estate inventory, such as a grievance about the last weeks or about the funeral. Note that it is playing if it affects the cooperation, but do not mix it with the valuation of the home. Refer to the notary if the parties want a judgment, without saying who is right. You keep the process arrangement: who speaks to whom, and when you expect an outcome. You fill the outcome in only once they have put it on paper. Until then the dispute remains an open task beside the facts that are fixed.

If an heir distrusts the executor, the administration is the businesslike answer. Supply the documents that belong with the task, within the limits the will gives, and let the notary determine what you must hand over. Do not respond with a long defence in the group email. A short acknowledgement of receipt and a task to inform the notary keep the tone in check. Also keep the accusation itself; throwing it away makes the conversation less sharp later. A complete trail is not an admission; it is the basis for whoever must judge afterwards, and that is not you in the software.

This is an administrative checklist, not legal advice. The notary, the bank or the body concerned decides what this file needs and in which order. Ervazo keeps the tasks, the letters and the recorded values. The program does not send the letters, does not pay any debts and does not file a return. For each step, note the date, the person and the document you have received. What is still missing stays an open task. A ticked line means only that the administration has been updated. Do not close a dispute because the loudest voice has stopped writing.
