Maintenance arrears up to the date of death

Maintenance arrears (alimentatie) up to the date of death can be a debt of the estate inventory or a claim of the estate inventory. Which of the two, the agreement says, together with what really has not been paid up to the date of death. The deceased may have been the paying party or the receiving party. You read that in the agreement or in the decision that sets the maintenance, not in a habit of the last months. Put the documents with the item. Without a document the amount stays empty and the direction open: not yet known whether this is a debt or a claim. A relative who names the monthly amount from memory does not supply a source. Note the message as an internal note and keep the field empty.

The arrears you record run up to the date of death and not after it. Do not count the monthly instalment on as if it of itself remains due after the death. Every month after the date of death that you still book as a debt or as a claim makes the estate inventory longer than the documents carry. On the item put the period the arrears cover, ending on the date of death, and only if the agreement and the payment documents support that period. If a month is missing in the trail, you leave that month open instead of aligning it with the previous one. The current value of an account is a different field. It is not the maintenance. Keep the arrears as a line of their own, with a source, or leave them empty.

Do not share a maintenance amount in the portal for as long as direction and period are open. An heir who sees a debt reads a determination. Until the agreement is there, the amounts layer is not the turn of this item. A letter that names a monthly amount after the date of death as continuing stays a draft and does not go to the letters layer. The task is: request the agreement, lay the payments up to the date of death beside that agreement, and only then choose debt or claim. Staff see that task in the workspace. The internal doubt whether the maintenance concerned a partner or a child stays internal until the document says so. You do not fill that doubt in with a kind that makes the conversation handy. The document chooses, or the field stays open.

Ervazo stores the maintenance as an item with an empty or filled direction, depending on the document you link. Ervazo records and calculates as a worksheet. It does not of itself let the monthly instalment run on after the date of death and it does not choose between debt and claim. That is not advice. It files nothing and it pays nothing. The program makes no new instalment after the death and it pays out no maintenance. The agreement and the payment documents up to the date of death are the source. Without that source the amount stays empty and the task open. The worksheet only counts along what you have set as a debt or as a claim with a source. A month calculated onward is not a fact.
